The initial checks are scheduled to be mailed to covered individuals this summer from August 14 to 25. The checks will be mailed by geographic region. We should know the order of states in the next week or so.
All covered individuals will be informed when they receive their check that they have 30 days from the date of the check to appeal the amount of their award. They will also be told how to initiate an appeal. Employment data impacting the amount of an award that can be appealed includes the fiscal years during which an individual was employed by CBP, years in which an individual “capped out,” and a payment offset based upon receiving an earlier payment under another covered grievance settlement. Individuals who are filing an appeal will be told NOT TO CASH THE CHECK.
Checks will expire 60 days from date of issuance, so non-appealing recipients should promptly cash their checks to avoid losing their award. Covered individuals should also be reminded to update their home mailing addresses.
After the August distribution cycle is completed and related appeals are resolved, the remaining funds will be distributed. The objective is to accomplish this before the end of CY ’17 so that both payments can be captured in a single W-2 for CY ’17.
Based on the settlement administrator’s initial calculations, which are still being finalized and are subject to change as we get closer to distribution, we are pleased to note that a majority of the 25,000 employees and former employees covered by the settlement will receive awards totaling in excess of $5,000. Fewer than a quarter of employees will receive awards totaling less than $1,000. In many cases, that is because the employee was not in a bargaining unit position for at least six months during the applicable fiscal year or the employee had already received a substantial payment under a grievance covered by the Global Settlement.
